This can't be right. I refuse to believe it. So, in someone's mind this made more sense than just adding the Chinese to the ethnicities discriminated against during the Apartheid?

This actually makes sense. It's not perfect (I'm assuming this is a legislative issue by the background the article provided) but the courts at least addressed the status of the ethnic Chinese as best they could and provided relief.

That's what I thought, too, but the article makes it clear that Chinese people living in South Africa during apartheid were treated somewhat differently than black people. It sounds like creating a different category for the sake of affirmative action policies might have been more logical.

It's easier to provide injunctive relief than change the laws and probably a bit more timely. I'm sure the legislature will get around to addressing this by changing the laws or, if it's policy and not law, get it changed post-haste.

Of course, I have no idea how South African courts or government work so I'm just talking out of school here.
