American Apparel says "How are we ruining Woody Allen's image? He already did!"

My first question is: how is this relevant to the case? They're basically saying they used a pervert to sell billboards and they don't think they should have to pay the pervert for using his image because he's a pervert.

I mean how is that not a cheap shot?

I guess they're arguing that Allen can't claim advertising tarnishes his image since he's tarnished it himself. But that doesn't get around the fact that you can't use someone's likeness for promotional purposes without their permission. And just because I smoke doesn't mean you can't be charged with murdering me.

That's a Lionel Hutz defense. I'm surprised the judge didn't laugh it out of court.

As for this case, what Phil said. Unless the studio gave them permission and Allen said otherwise. But I don't know anything about the case.

I'm not sure how it tarnishes his reputation. Unless being connected with snug fitting clothing and a creepy CEO is damaging.
