Neil Gaiman won is suit against Todd McFarlane

From Maggie Tompson blog:

Quote:
The decision came in Case #02-CV-48-BBC, Neil Gaiman, Marvels & Miracles LLC vs. Todd McFarlane, Todd McFarlane Productions, TMP International and Image Comics. It had been determined that Neil Gaiman had been co-creator with Todd McFarlane of Spawn #9 and, with that issue, the characters of Count Cogliostro, Medieval Spawn, and warrior angel Angela. The current suit involved the ownership of characters that had appeared over the years in McFarlane's "Spawn" titles, specifically "Dark Ages Spawn" and warrior angels "Tiffany" and "Domina."
I just can't believe McFarlane's hypocrisy in this. When he started Image Comics he was always going on about how it was about the creators getting their due unlike Marvel who had screwed Jack Kirby over. Screw him.

I'm also amazed McFarlane is still in good financial health. People still like his crap?

It's less about staying relevant than in not being utterly stupid when you make millions of dollars.

Like buying baseballs for millions of dollars?

Well, yeah, there's that. Dunno how much a property like Spawn is worth...plus he was a hot artist on non-creator owned stuff.
Does anyone still buy his line of action figures? They used to be "the shit" back in the mid 90's.

His comics company is in bankruptcy, I believe.

My favorite part of the ruling:

Quote:
If defendant really wanted to differentiate the new Hellspawn, why not make him a
Portuguese explorer in the 16th century; an officer of the Royal Navy in the 18th century, an
idealistic recruit of Simon Bolivar in the 19th century, a companion of Odysseus on his
voyages, a Roman gladiator, a younger brother of Emperor Nakamikado in the early 18th
century, a Spanish conquistador, an aristocrat in the Qing dynasty, an American Indian
warrior or a member of the court of Queen Elizabeth I? It seems far more than coincidence
that Dark Ages (McFarlane) Spawn is a knight from the same century as Medieval (Gaiman)
Spawn.
U.S. District Judge Barbara Crabb--best Spawn writer ever?

Frankly, I'm amazed that Marvel didn't hit him and Kirkman with a "cease and desist" over this one.
WTF is that?? Haunt looks like he's coming from his fingertips.
That Haunt ad looks like it's from early 90's Image, when they had virtually no graphic designers. Not to mention the character looks like shit.

That said, I kind of still like McFarlane as an artist. He was always different enough and detailed enough that I dug it, and even though his anatomy was horrible it still came off well(unlike Liefeld).

I know the courts are slow, but I'm amazed it took this long.
Gaiman said on his Twitter the other day: "A few people are asking why Todd & I didn't have contracts. We did. He just broke them."

lol

"warrior angels 'Tiffany' and 'Domino'"

Oh, Image Comics.

It would have given it more attention than it deserved.

I think Tiffany was named after Todd's sister.

But yeah, she was esstientially exactly the same as Angela characterwise ... only younger, brasher, and more "in your face". Ugh.

The really puzzling thing was that when in costume his characters have perfectly good hands and fingers. But once out of the gloves, they become these weird deformed sausagey things. How the fuck does that work?

I think I might have that Gaiman/Angela issue of Spawn. Is it worth any money? Better still, can I return it and get my self respect back?

The answer, as it is with pretty much anything printed in the 90s, is no.

Maybe if you had the glossy foil 3-d variant.

I once read an interview with libertarian Todd McFarlane and he waxed poetic about contracts. He said the best contract is no contract since, if he likes what you're doing, he'll have to pay to keep you happy.

This is why you have contracts, Toddy.

I've said it in "Haunt"s old thread, but he should have been named "Spewn".

"Cummin' atcha!"

This is an interesting question, I believe.

What does one do with all the books they have from the 90's that have to be worth a tenth of the cover price? Do you parcel them out to young children, keep them locked away waiting for paper to become scarce or try to Ebay them to someone...anyone?

If you wanted to be really evil, you could scan and adapt them into motion comics and give them accurate 14 year old over-excited douche-bag voice readings.

I gave away most of my comics to goodwill.

So my death of Superman comic is worthless... DAMN IT

Wow, I never would've known Erik Larsen had such a negative view of women, considering how nuanced and three-dimensional the DD-breasted prostitutes and lesbians in the Savage Dragon are.

That's what I'm saying! Very few men took such care to truly understand the intricacies of a camel toe.
This is Larsen's "pack of all female jurors" moment.

I doled mine out at a garage sale. Only sold them to kids and for whatever they could give me. Pretty telling that my Alpha Flights and Spider-Mans and Supermans and Batmans all went, but I ended up tossing a bunch of Spawn and Wildcats and other assorted Image nonsense.
A good load of mine went to the recycle bin. I figured they were more valuable as new paper.
Good for Gaiman; he's been a favorite for a while now, and McFarlane and Larsen are such douches that I can't help but root against them.

Fuck McFarlane.

One I opened and one I didn't.

I also have this. Seems it went for $3000 at auction in February of this year. Seems like I need to send mine off to get graded.

Ugh. Precisely what went wrong with comics. I guarantee you whoever buys that is never going to read the goddamn thing.
Well of course, at this point, there really isn't a point to buying high priced singles to read.

That's collected in a TPB, isn't it? If you're planning on reading it, buying the trade makes much more sense than buying that thing.

Again, why isn't this douche completely broke?

Story time: When I was like 13 I went to my first comic book convention in Phoenix and met McFarlane. He literally refused to make eye contact with me, or any of the other people that just stood in line for half an hour for a PAID autograph. Pretty cold. Turned me off to pretty much the entire comic experience for years. Later I worked at Kinkos and learned he regularly went into one of the southern greater Phoenix area stores on a regular basis. Everyone in the store hated him and made fun of his Donald Duck voice.
Poor bastard just had to start his superhero's name with an S, didn't he?
I blame myself.

Back in '93 or '94 I had a chance to keep all of this from happening. A buddy and I were 'talent' at Chicago ComiCon for a couple of years (some small press stuff from Fifth Panel comics, I'm sure you all read them). I was heading backup to my room after the show wrapped and on staggered McFarlane, drunk and acting stupider than usual. I choked back the reflex to beat his bitch ass as we road up the elevator. One of my biggest regrets in life.

Yeah, but it's a Venom comic from the 90's...why read it at all? It's not like this is Dickens or anything.
Sorry to hear Larsen is a dick. I'm still a big fan of his comics though.

I used my 15 near mint copies of NFL SuperPro #1(guest-starring Spidey!) as kindling last winter. It was cold!

A thousand times this.

"But your honor, he ran my client over twice and then burned down his house."
"That may be, but he's Neil Gaiman and your client is Todd McFarlane."
"Point taken."

Are you advocating NOT buying singles at all? I believe there is still a market for the collecting of pre-90's single issues as speculative artwork. Anything after that was mass produced because of speculators buying five+ copies of everything that came out and artificially increasing printing runs therefore causing a direct drop in worth.

Buying CGC books is a thought but I'm not sure I would unless I just could not find the grade of book I wanted unslabbed.

I bought one CGC book but that was only because in the short run of issues I was buying all of them and for some reason this one book was slabbed.
