I for one would refuse to give out my name if I'm told it's to be placed on some mysterious "database". Law enforcement abuse is unfortunately rampant, and the cops shouldn't act so shocked when honest citizens no longer trust that they have our best interests at heart.


EDIT: As for being on someone else's property and refusing to identify yourself.. she was leaving their property, and she was a paying costumer. Just because the law gives cover to the officer's abusive and over the line behavior does not give him the moral authority to cuff a mom in front of her children. That is NOT why we empower law officers in the first place. They need to know when to show restraint, because this incident (and the thousands more like it every year) seriously erode our trust in the very institutions they're sworn to protect

Now if it was a stranger, I'd understand not giving them any info.

Sorry, but if a cop asks for my name, I'm just going to give it to him. I don't care. I have nothing to hide. If you refuse to give your name, it's really suspicious to an officer. If you didn't do anything wrong, why be so difficult?

If you're really that far up your own ass and feel so self entitled that you're going to be difficult to a cop who simply wants to see your ID...then you asked for it.

As for the officer, it was a female officer, and she was checking out the disturbance over the park kicking her out AGAIN (over three days, because she's too dumb to find a real swimsuit or a dark shirt. THREE TIMES!) and it's NORMAL for a cop to ask to see your ID or to have your name.

While there's a policy that won't let officers search your car or property without probable cause, I've never heard of a policy that forbid them from seeing your ID or asking your identity.

Oh and you can be arrested for failure to comply with an officer's order. She could also be arrested for disorderly conduct. She could also be arrested for resisting arrest, since that's why her arm was twisted. I mean there's def things they can get her for. As far as I've read, she hasn't been charged with any of those. I'm sure it'll come out soon though.

So in conclusion:

Cop needs to learn to effectively communicate. She failed.
Mom needs to listen when cops make requests and maybe buy a bathing suit.
Water park needs to get an STD.

Wrongful arrest. Period. I hope her lawyer sues the fuck out of the city, her civil rights were violated.

If a cop asks me for ID for no reason? Fuck no I'm not giving it to him. I have a right to privacy, and I have a right to not subject to unlawful search and seizure, because the US is not a fucking Fascist state. If he has any good reason to ask for it, if course I'll comply. By the way, I'm still stunned by the fact that people seem to think "being a cunt" or "being a stubborn bitch" is an arrestable defense.

Same here. The idea that people can sic the cops on me for wearing clothes I don't like in public is much scarier than the idea of people walking around in public wearing clothes I don't like.

Feels like there's a lot of anger behind the harsher insults being thrown at the woman.

Hope she sues the shit out of the city. And wins.

Your right to privacy doesn't extend to withholding your name from an officer. The officer in the case didn't ask for an ID, she asked for the person's name. The Supreme Court ruled on it in 2004. The 4th, 5th, and 14th amendments don't protect you. [Link] Had the officer asked to see some identification, then yes.

Now, this I am sort of with you. I am not sure that calling her names is worth it and don't know that being stupid should be an arrestable offense. But the police officer is investigating a disturbance. A quick talk, sort things out, and everyone goes home.
