Fangoria has a report on Romero's 4th "DEAD" film and in part it says:

(A rights dispute is also delaying progress on LAND. "I have to do an arbitration with the MPAA over the titlt, and I don't know how long that's going to take." Romero elaborates that Richard Rubinstein, his former partner at Laurel Entertainment, has registered the title NIGHT OF THE LIVING DEAD with the MPAA, despite the fact that Rubinstein did not form his relationship with Romero until long after the original NOTLD. Romero only recently joined the MPAA and is unsure when the arbitration would occur. He confirms that "that's what's hanging (LAND) up right now".

Some have called the new "DAWN" a homage and a tribute. They have said that it is being made by fans of the original. It appears that these "fans" may cause Romero to have to go to court to use the "DEAD" title for his 4th zombie movie. IMHO the only reason they would do that is because they want to take over the series. This won't change the future of horror. It won't even prevent Romero from making another zombie movie. He just won't be able to say that it's part of the NIGHT OF THE LIVING DEAD series nor will he be able to use the "DEAD" title. I just wonder what everyone thinks about this turn of events. I know I will not support a Richard Rubinstein movie again.

I'd be interested in why exactly he can't use the DEAD title. I mean there has been THE DEAD HATE THE LING and that god-awful Steven Seagal flick HALF PAST DEAD so why can't Romero name his film LAND OF THE DEAD??? I don't get it. Can a single person buy the word "DEAD"? That would be insane! Do his rights only reach so far that there cannot be any Zombie films with the title DEAD in them? And that would still leave DEAD HATE THE LIVING with which he had nothing to do according to the IMDB.

It seems that the title was never registered with the MPAA, whatever that means. It could be that the MPAA will fine he if he uses the title. I just know that this is wrong.
