Mystery Hearing Set for West Memphis Three

Thanks for the update; the news on this had escaped my notice today, although I imagine it might generate a lot more coverage tomorrow depending on the results of the hearing.

As I understand it, the Alford plea is an accusation by the defendant that the state is too backward to exhonerate them despite not having a case.  Still, a no contest is a no contest, and the plea will likely prevent the three men from seeking compensation from the state in civil court.

Yeah, but I read that their lawyers are still going to fight for full exoneration. Jason Baldwin at first refused to take the deal, but like he said, if he didn't, they would have kept Damien Echols on death row, and he was on his last appeal. Like Baldwin said, "They were trying to kill Damien."

 

Man's a fucking hero of the highest order.

A decent lawyer could get that plea thrown out in 4 seconds. I'm pretty sure, "sign this or go back to the cell you've spent 18 years in - or death row in one case" qualifies as duress.

Like I posted before you, Echols was on his LAST appeal. They copped to this bullshit plea to save his life. That's straight-up heroism.

“We wanted to see Damien, Jason and Jessie walk free. That did happen, but not before we had to sit through a self righteous lecture from Arkansas State Prosector, Scott Ellington. Kind of tarnished the joy of seeing them released. I need to vent,” Jackson wrote.

Describing the case against the trio as farcical and a miscarriage of justice, Jackson also confessed to having to “suppress a deep anger” due to the circumstances of their release.  

“Let's not think for a second that justice was served today.  Far from it,” he wrote

“So the 'Alford Plea' was entered, and Damien, Jason and Jessie walked free this morning - all that was missing was justice. Justice did not play a role in the proceedings this morning ... not to the 3 men who have been robbed of 18 years, not to the 3 young victims and their families, and certainly not to the people of Arkansas, whom the system is supposed to serve."

“There's also a triple child killer who has walked free for the last 18 years ... seemingly an unimportant detail in today's white-washing job,” Jackson wrote.  

Activist group Free West Memphis 3 said the support of Jackson and Walsh had been "instrumental" in the release of Damien Echols, Jason Baldwin and Jessie Misskelley after 18 years.

According to a statement from the group, Jackson and Walsh, “funded key investigative efforts on behalf of the defense, in an effort to prove the wrongful conviction of the three men in prison.”

 "As we became more familiar with this case, we began to understand there was a powerful will to see three innocent young men die in prison, thereby compounding what was already a terrible tragedy," Jackson said in the statement. "We felt any support we could lend, to stop this from happening, was worth our best efforts and there are many, many others who have done the same."

Jackson and Walsh funded an extensive private investigation over a number of years, which led to uncovering crucial new DNA evidence; they were instrumental in hiring some of the country’s leading forensic experts to re-evaluate the case and uncover new witnesses, all of which contributed to the Arkansas Supreme Court’s decision to reopen the case.

Jackson’s spokesman, Matt Dravitzki, told New Zealand newspaper The Dominion Post on Sunday that Jackson and Walsh were moved to help after seeing HBO documentary ParadiseLost.

"Peter and Fran have funded seven years of investigation into trying to get these guys freed," he said. "They saw Paradise Lost eight years ago and that put them into action."

The couple's interest was not professional, and they had no plans to turn the trio's story into a film, he said.

"It simply comes from them being in a position that they're able to [fund] that. It's humanitarian entirely - it's philanthropic."

He did not say how much the couple had spent on the case.

Just so I'm clear, there's quite literally no reason other than a blatant and obvious whitewash on behalf of Arkansas State Authorities that Terry Hobbs still walks free today is there?

 

Is there no federal judicial oversight for such shameless and bald faced corruption on behalf of a state?

I imagine that eventually we'll just allow some states to secede so we can get on with the 21st century without them.  Arkansas wouldn't be missed.

I lost respect in peter Jackson. How can you watch Paradise Lost and not think the boys did it? It was so obvious. The scene where the dad is down at the river crying couldn't be faked, and the boys seem like they don't care which is a sure sign of sociopathology.

Glad these people are out from under the Sword of Damocles, but the fact no one in the state government is willing to step up and offer an apology, the fact they're essentially saying "Fine, we won't kill you or continue your wrongful imprisonment, but don't hold your breath waiting for us to clear your names much less say we're sorry".... it's simply abhorant. The justice system in this country is in desperate need of reform, and stories like this should have every American outraged that those elected to serve us apparently consider such a gross miscarriage of justice to be no big deal

It's interesting how that sort of info is coming out now.  I remember the second Paradise Lost film turning the spotlight on John Byers.  I was kind of annoyed that they did that.  Optimistically I hope they were making a point about how easy it is to railroad someone with circumstantial evidence (circumstantial evidence that's actually better than that used in the original conviction!),  but they didn't underline that clearly enough that I can recall.

 

This whole thing has been one of the better and more public arguments against the death penalty in any case.  Support your local innocence project folks.
