A United States federal judge in Oregon has ruled that a Montana woman sued for defamation was not a journalist when she posted online that an Oregon lawyer acted criminally during a bankruptcy case, a decision with implications for bloggers around the country.

 

Crystal L Cox, a blogger from Eureka, Montana, was sued for defamation by attorney Kevin Padrick when she posted online that he was a thug and a thief during the handling of bankruptcy proceedings by him and Obsidian Finance Group LLC.

 

US District Judge Marco Hernandez found last week that as a blogger, Cox was not a journalist and cannot claim the protections afforded to mainstream reporters and news outlets.

But she's not a journalist. 

 

Seems like she chose the wrong approach for her defense.

Bloggers Can be journalists, but aren't expressly so. ThinkProgress is a blog, that I would consider journalistic.

 

That said, 2.5Million just cause someone was mean to you online? here's a tissue, suck it up.

Journalists can be bloggers - that doesn't make all bloggers journalists.

This is total bullshit, and my initial gut reaction is the ruling is bullshit too. What qualifies as a "legitimate news outlet"? FOX fucking News? Any national publication paid for and steered by its advertisers? That's crap. Anyone who publicly publishes a legitimately sourced news story or a factually supported opinion piece should qualify as a journalist and be entitled to the appropriate shield laws. This isn't the 1940s.
