Schumer’s office said the senator was not in Washington, D.C. or the United States during several dates in the document when he is said to have harassed the staffer. 

“The document is a forged document and every allegation is false,” Schumer spokesperson Matt House told The Daily Beast. “We have turned it over to the Capitol Police and asked them to investigate and pursue criminal charges because it is clear the law has been broken. We believe the individual responsible for forging the document should be prosecuted to the fullest extent of the law to prevent other malicious actors from doing the same.”


The former staffer, who spoke on the condition of anonymity, confirmed the document was a forgery.

I hope those of you that actually engage with the president on Twitter take repeated opportunity in the coming months to remind him of that time he managed to endorse two losers in a single election, in what should have been his party's safest district in the nation.  And it was an election that only took place at all because he appointed the prior senator to a position that he immediately wanted to fire him from.  Except he can't find the balls to actually do it.

Can someone familiar with libel/defamation laws give us some kind of read on how much culpability a person can have for passing on false information/forgeries as opposed to actually creating the forgery?  Because I could easily see that turning into an open-and-shut case where some no-name intern goes up the river and Cernovich and Johnson just say "We didn't know it was fake, sorry!"

Criminal libel prosecutions are rare, and less likely in this case because only some states (NY and DC not among them - and nothing at the federal level) have criminal libel statutes on the books.  Tbh, it may be better it doesn't go that way.  I don't want the current crop of dipsho-fascists to get it into their heads that there is a way to more aggressively threaten accusers who come forward about their misdeeds, while putting the bills on the public ledger.  

 

What is a bit confusing about libel and defamation, as I understand it (which is not well), is that the burden of proof can be actually higher in the civil counterpart than a criminal case.  As opposed to your classic OJ scenario - where he couldn't be found guilty of murder beyond a reasonable doubt, but could be found civilly liable for wrongful death under the looser "more than likely" standards - a civil suit for libel against a public official requires a finding "actual malice" on the part of the publisher. 

 

Some things to keep in mind about "actual malice" are that 1) "reckless disregard" for the veracity of the statement will do even if actual knowledge of its falsehood cannot be proven, 2) these trashheaps made that showing super easy with social media posts preemptively crowing about how they are going to "end the career" of a senator, and 3) Schumer is doing this to make a statement, and so is less likely than your average plaintiff to settle quietly out of court.

 

 

Anyone with actual experience in this field feel free to correct me.

This looks to me like Ryan getting ready to run in 2024 or at a stretch 2028. 

 

He retires, lets the horrorshow of a Tax Bill cause a massive recession that the one to two term Democratic President in-between struggles to recover from, and then rides the wave of "we didn't recover fast enough!" into the White House on a platform of "Those poor people are stealing your (read: White People's) money and that's why the economy is bad/we didn't have a REAL recovery!"
