Marking the latest lost battle for gay rights activists, the state Supreme Court refused to strike down Louisiana's 197-year-old ban on oral and anal sex Thursday, saying it would contradict a precedent set by the court on a similar challenge two years ago.

In a unanimous vote, the state Supreme Court said the law does not violate the privacy rights provided to citizens under the state Constitution, as the Louisiana Electorate of Gays and Lesbians Inc. charged when it filed its civil case in 1994.

To support its decision, the court revisited a July 2000 ruling involving a criminal case in which a man was acquitted of rape but found guilty of engaging in oral sex.

In that case, the court ruled 5-2 that the law did not violate privacy rights.
Just think, this also counts for hetero folks too. So just think about that if you visit New Orleans and participate in a little oral hanky panky. You are breaking the law!

Gawd, and to think that I lived there for nearly 4 years. Wonder how many times I broke the law wink

Ok, anal sex and oral sex are illegal in lots of states. I dont think one person in any of them actually pay attention to that law though.

Fine, sodomy is illegal in many places, a law virtually unenforceable and roundly ignored.

SO WHY HAVE THE F'N LAW?

I'm ragingly straight, and I would've violated this law numerous times. As I'm sure members of the police dept., city council, judiciary, maybe even ministers, have. So what's the point in keeping it on the books? It's archaic and worthless, and there's no reason for it to exist, except mainly to place an unenforceable restriction on homosexual intercourse.

The state that has Mardi Gras refuses to strike down a sodomy law. Obviously, that law is just given "lip" service.

Conversely, there was a case in texas where two guys were enjoying each other in their own home, blinds shut, when the police broke in because they had the wrong house on the block for a warrant. They were arrested, and much publicity ensued.
I think they were eventually aquitted, but I'm not sure.

HILLSBORO (AP) - Hoping to convict some adult video store patrons suspected of engaging in a prostitution ring, authorities have charged six men with having homosexual sex.

Under Missouri law, "deviate sexual intercourse with another person of the same sex" is a rarely prosecuted misdemeanor. Jefferson County prosecutor Bob Wilkins called the law "obscure."

He said that he was hesitant to use the controversial statute, criticized by gay rights advocates as homophobic. But Wilkins said that it was necessary to stamp out the "open and notorious activities" at the video store.

"It is not my intention to judge the conduct of consenting adults," Wilkins told the St. Louis Post-Dispatch for a story in yesterday’s editions. "This is not about throwing homosexuals in jail. This is about trying to prevent future conduct."

The men were arrested earlier this month in a raid on Award Video in High Ridge. Those patrons who were arrested for having sex were in the pornographic theater area of the store at the time of the raid.
