I've listened to virtually every Sirius Stern show since he launched in January, and it's been his best work since at least the mid-90s. He's hardly a has-been at this point.

No shit....he's been bitching at the FCC ever since they started fining him for his on-air antics. His show suffered as a result, since station management had him on a two minute delay and would bleep anything that was borderline objectionable.
That alone was enough to drive him away from radio. The fact that Sirius offered him virtually unlimited creative control (and a boatload of money) made it an easy choice to make. Ever since the switch, he's actually been cheering them on, since he's in unregulated territory, and those on "free radio" are indirect competitors.
As far as CBS goes, Stern left amicably. The only point of contention was that they withheld the release of Stern's tapes which cover his post-NBC period, but that could've been worked out since Stern held the IP rights and CBS couldn't use the tapes without that anyways. The shit hit the fan once Moonves filed that bullshit shoddy lawsuit, which makes the REALLY weak argument that Stern "pirated" CBS' airwaves without their knowledge.

I've never heard O&A, but how could that possibly improve their radio show? The beauty of satellite radio is that anything goes. If Stern were to syndicate to terrestrial, then he would be under the same FCC regulatory restrictions he was trying to escape in the first place. Sure, I guess he'd get more money, but as a fan, the LAST thing I'd want is for him to return to terrestrial.
Maybe O&A can be funny without pissing off the authorities, but in today's climate, who knows what they'll start restricting tomorrow.

Maybe you weren't paying attention, but Stern DID finish out his contract. He gave CBS about 14 months of notice that he would NOT be renewing his deal, and that he was headed to satellite radio. CBS had a year to plan for his exit, and as expected, they weren't able to immediately fill the void, which led to the collapse of their ratings.
CBS had the option to pull Stern off the air for the remainder of his contract, but they couldn't bear to have their advertising cash cow on the bench. After a year of killer profits while cashing in on his grand exit, now CBS is claiming that Stern caused CBS irrepairable harm while under their employ.
The only harm he caused CBS was by finishing his contract and deciding to work elsewhere.
