Can I paint a Batman dragster?

Hi everyone.

I am custom car painter and former movie theatre manager who was approached by a customer who wants his dragster painted in a Batman theme. It is a 260 inch long top fuel style 632 c.i. monster.

As a Batman geek, painter, and custom car guy this is a dream job.

Does anyone know the legalities of this? There is no money to be exchanged per se for the work, but the car will be in regular view of many people.

How far can I go? I can make it batmanesque but I really want to have my own style batman symbol on there and was toying with some gotham city scapes and a classic top-of-the-city pose.

Does this fall under fair use?

Any advice is greatly appreciated.

Now I'm no expert(far from it, actually), but I would think it would be fine. I'm sure a few people on here could answer your question far better than I can.

Just make sure you post some photos of it on here when you're done, I'd like to check it out.

I'm pretty sure you have nothing to worry about. As long as you're not using the Batman character for merchandising (say putting the dragsters' paint job on a t-shirt, or getting a die-cast model of the dragster with the paint job), and as long as you or the driver doesn't make any money or promotion off of the image, DC Comics or Warner Bros. won't bother with you.

If you're still concerned, contact Warner Bros. or DC Comics through their websites, explain what you're going to do, and ask for permission. That, or use a different character, like a vampire or something. That way, every bit of the artwork is your creation, you can still use the city and stylized bat elements, and you can eventually use the artwork for merchandising, and keep all the cash.

Won't the owner be the only one facing legal action if this goes down? I mean, why not go hog wild and paint a Gotham rooftop where Batman, Bat-Mite and Nightwing fight the Creeper and a mind-controlled Huntress?

Because you just plain don't paint Bat-Mite on a dragster. It's just not to be done.

I got a friend who has tatood Batman, Kane, Cat Woman and Penguin in profile on his arm. It looks cool, but I would never do it.

I think it is ok, the tattoo artist was paid, so if you do it for free, I don't see a problem.
