It seems to me that giving up the right to live with your sister is a small price to pay when the alternative is living away from your sister while you're in prison for 10 years. The laws may be archaic, but having courts and juries uphold them is not.

Extremely disturbing.
How did we get from a girl volunarily fellating a boy to "gangbangs on videotape"???

The part that pisses me off is the suggestion that he should be grateful to only be unjustly labelled a pedophile and removed from his family, just because there's an even harsher unjust punishment he could be saddled with.

" Your honor, I may have raped and killed her but I only did it because she kept screaming. If she would just shut up for a while I wouldn't have strangled her. So it's her fault too."

I hope that if this prosecutor hears this as an argument in a trial he'll appreciate the irony.

Judge says Genarlow Wilson should be released

Quote:
A judge on Monday voided a 10-year sentence for a man accused of having consensual oral sex with a 15-year-old girl when he was 17. He instead gave Genarlow Wilson a 12-month misdemeanor sentence with credit for time already served.

The state is likely to appeal the ruling.

Wilson's original sentence, for aggravated child molestation, was widely criticized on the grounds it was grossly disproportionate to the crime, and state lawmakers later passed a law to close the loophole that led to the 10-year sentence.

Wilson, now 21, has already served more than 27 months. He could remain behind bars while the appeal proceeds.

A jury found the honor student guilty in 2005 of aggravated child molestation for having oral sex with a 15-year-old girl during a 2003 New Year's Eve party involving alcohol and marijuana. Although the sex act was consensual it was illegal under Georgia law.

Wilson was also charged with rape for being one of several male partygoers at the Douglas County hotel to have sex with a 17-year-old girl, but was acquitted. The party was captured on a videotape that was played for the jury.

Several influential people, including former President Jimmy Carter, stepped forward to support Wilson.

Wilson's lawyers could be heard applauding in their office after the order was released.

Why? Everyone with a pulse has said the law was too much. The state legislature changed the law. Why the hell would the state want to prolong this embarrassment by appealing the decision?

And on top of that:

I guess Georgia is still upset about the last time they had to free a bunch of African-Americans.

Is there any way the federal government can intervene here? This is completely absurd.

Glad I didn't go to high school here.

Just saw the kid's lawyer on TV.

This is the attorney general behind this, no idea yet if that asshole prosecutor is involved in this (wouldn't be surprised if he is).

They want him to serve 10 years and keep him in the sex offender list.

I thought that the prosecuting attorney even believed the sentence was egregious, if I remember the article correctly.

Still stupid, but I'm thinking this must be some standard policy to appeal anything that gets overturned in this way.

Have we discussed the fact that Genarlow is not a name?
Yeah... babynames.com said "Sorry, no matches. Try again!"

Furthermore, babynamesworld.com said "Your search did not match any names. Please make sure your search query is spelled correctly or try a different query."

That's some made up shit there. The African Americans love to do that. I only googled 2 websites, but babynames.com is irrefutable proof of that particular stereo-type. They must be an authority... they were 1st at the top of the google list.

Maybe Genarlow's an anagram, acronym, or abbreviation. Not really.

You must spread some reputation around before giving it to Richard Dickson again.

How about the fact that the Georgia state Attorney General's first name is Thurbert.

Jesus, the hell is with the legal system in the south. This and that bullshit Durham with the DA over there. Thankfully that asshole is on ethics charges. Hopefully this idiot gets tossed out at the next election.

The state has filed an appeal. Grindylow (or whatever) will not be released pending appeal.

Holy ... Thurbert Baker is black as well?

I just can't make any sense of this at all anymore.

From MSN:

Court Frees Youth in Consensual Sex Case

I like how the decision wasn't unanimous and some of the dissenting judges consider it a "travesty of justice" for Wilson to have the new law apply to him. Every time I think of a court in Georgia, I imagine it is filled with the Kuato Lawyer from S1 of Venture Brothers. (I couldn't find a picture of Tiny Attorney so this cosplay pic of Dr. Venture will have to do)

And yet the kid will still have a criminal record for the rest of his life because he basically made out with a girl only two years his junior.
They got the "travesty of justice" part right.
See, this is why I never go to parties in Georgia.
