Hard to feel quite so bad for Josh Hancock now...

Yeah, like I said in the MLB thread, this is inexcusable. A BAC level that high means he was legitimately drunk -- it wasn't a "had one too many" situation. I'm just glad he didn't kill anyone else. Jerk.

The guy hit the quadrifecta of poor decision making:

1)Talking on a cell phone;
2)Blood Alcohol content that was more than twice the legal limit;
3)Not wearing a seatbelt;
4)going 68 in a 55 mph zone.

I'm sad that he's dead, but even more relieved that he didn't take anyone with him.

I don't think they've said yet whether he was high or not. With all the other stuff, I wouldn't be at all surprised.

And they've already got the patches -- I wonder if they'll keep them.

It'd be kind of hard to remove them at this point if they're already wearing them, but there needs to be some strongly worded statements disassociating the memorialization of a friend and teammate from the lifestyle choices that got him killed.

Shame the Cubs had to postpone that game. Should be a forfeit. They knew he was a drunk and had talks with him. Kile is one thing, this is another.

the article also mentions that Hancock was on his cell phone, immersed in a conversation about baseball. and studies have shown that talking on the phone while driving is equal to drunk driving, due to the slowed reaction time.

So that means he was really triple drunk. crazy.

Tony LaRussa is adamant: they didn't know Hancock had a drinking problem.

LaRussa's comments are perplexing. Forget for a moment that LaRussa's been Hancock's manager for years, how is it that LaRussa can simultaneously be unaware that Hancock had a drinking problem while admitting that he reprimanded Hancock last week for being hung-over/woozy at game-time? Maybe LaRussa figures that if you haven't been pulled over for a DUI, which happened to LaRussa about a month ago, you're doing just dandy.

Hancock being a baseball player shouldn't have given him a free pass with the Cardinal organization. If you have an employee that you know has to commute/drive on a daily basis as part of his job, and you know he's driving to work drunk, how can you sit on your hands and do nothing. They should all be thanking their lucky stars that he didn't kill anyone else.

I didn't really want to look like an asshole and pile on a dead guy, but the thought of "ran into the back of a tow truck stopped with it's lights on around midnight" had the stench of "driving drunk" from the get-go.

I mostly pissed that is messed me up in my weekly scoring fantasy baseball money league. I really needed Rich Hill to get his start in by Sunday... but no, Hancock has to go and fuck everything up for me.

this happenes everyday to regular people... becuase it happened to a ball player people are going crazy... I knew he was drunk when I forst heard the report... still sad to see a life go tho

Well, the first lawsuit is in:

Let's recap:

1)Blood alcohol twice the legal limit (about .16);
2)On a cell phone at time of accident;
3)Speeding at time of accident;
4)Not wearing a seatbelt.

He is now suing the tow truck driver, the driver of the stalled car, the bar that served him drinks for 3.5 hours, and the tow truck company. Clearly there's a huge amount of comparative liability, but depending on the laws of the state I'd say that the tow truck driver/company (for not putting out flares), and the bar will need to get a liability analysis done asap.

I expect Josh's dad to add Major League Baseball as an Additional Defendant because it was their fault for scheduling the Redbirds to play at home that night, thereby exposing his faultless son to the predatory drink-servers and negligent tow truck drivers who were looking to cause this terrible tragedy. I also expect to see the suit get tossed or an eventual defense verdict pursuant to the common law theory of Are You Fucking Kidding Me? This is Contributory Negligence.

Is it wrong for me to laugh my ass off when someone calls this a tragedy? I hate it when anyone dies, but, stupid people contributing to their own demise does not a tragedy make.


The only tragedy: I'm sure it ruined the tow truck.

If I was a jurist on this case, I would award the Dad $1 from each party involved, because yes, they did contribute.

And then I'd suggest a new lawsuit to his dad: Sue yourself for raising an idiot.
